Mahoning to pursue action against zoning violator

Mahoning Township supervisors are preparing an action for zoning violations upon a report at a recent meeting by township resident Brian Mertz who complained about a problem with a neighbor who happens to be a cousin who allegedly moved a camper onto the property illegally and was beginning to excavate to construct a road to the property.

"My cousin is from Florida and he moved onto the property in August," said Mertz whose property is in front of the one in question. "He has his sump pump flowing into the creek since August and last weekend he brought equipment onto the property to dig a driveway."

Zoning Officer LeRoy Leibenguth reported to the board that the person has not filed a soil erosion plan nor applied for a highway occupancy permit both required to allow the construction of the driveway. It was also reported the resident never filed a moving permit when he entered the township.

Mertz said he confronted his cousin about his activities but the man became arrogant and refused to listen to him.

Supervisors agreed at the original meeting to research the issue resulting in the agreement at the November meeting to pursue action against the resident.
