Schuylkill man jailed for assault
A Schuylkill County man was jailed over the weekend on numerous criminal counts including rape and sexual assault.
State police at Frackville identified the suspect as David W. Smith Jr., 46, of Gilberton.
According to troopers Smith and a 47-year-old female became involved in an argument about 7 p.m. on Friday, Nov. 18, at 4 Schultz Road, in Gilberton. During the argument Smith allegedly punched, kicked, hit the victim and pulled her hair. He also allegedly threw various household items at her. During the assault Smith allegedly retrieved two guns from the residence, loaded them, and threatened violence if the police were summoned.
Smith did not allow the victim to leave the home. He also sexually assaulted the victim, troopers said. After Smith fell asleep about 12:50 a.m. on Saturday the victim was able to flee the home and called police. She was taken to a Pottsville hospital for treatment, troopers said.
Smith was taken into custody and transported to the county prison in Pottsville and arraigned by video by on-call District Judge David Platchko, of Port Carbon.
He is charged with aggravated and simple assault, attempted rape, rape (two counts), attempted involuntary deviate sexual intercourse, involuntary deviate sexual intercourse (two counts), attempted aggravated indecent assault, aggravated indecent assault, sexual assault, unlawful restraint, recklessly endangering another person, attempted indecent assault, indecent assault (two counts), and harassment.
He was committed to the county prison in lieu of $100,000 straight cash bail.
