Juries return verdicts in favor of defendants

Two jury panels in "slip and fall" cases returned verdicts this week in Carbon County court in favor of the defendants.

The suits involved the following:

Carla and Warren Leslie, of 585 Hill Road, Palmerton, as plaintiffs, against Paul and Johnette Walck, 250 Lehigh Ave., Palmerton, and Frank Depaulo Jr., of 6082 Hausman Road, Germansville, Lehigh County.

In the second matter the plaintiff was Elaine Hand, 16 Sam Brooke Circle, Lehighton, with the defendants being Frank and Barbara Smyczynski, of 82 Sam Brooke Circle, Lehighton.

In the Leslie action the suit charged that on Sept. 12, 2007, Carla Leslie was walking in the area of the Walck's home at 250 Lehigh and the adjoining property at 248 Lehigh, known as 242-244 Lehigh Ave., owned by Depaulo, when she fell and injured herself. The plaintiffs' claimed the sidewalk on the two properties was defective and alleged negligence against the defendants.

The jury found the defendants were not negligent and awarded no damages.

In the Hand action, it was charged in the suit that the plaintiff was exiting the defendants' modular home on Oct. 9, 2008, going down the back steps when she was caused to trip and fall down the stairs causing injuries.

Negligence was alleged against the defendants but the jury found no negligence and awarded no damages.
