Hearing on proposed cargo airport scheduled for Feb. 3
The Schuylkill County Zoning Hearing Board will hold a hearing on Thursday, Feb. 3, at the courthouse in Pottsville to decide whether it has jurisdiction to hold a hearing on the application of a Pittsburgh firm which seeks to build a cargo airport and business park partly in East Union Township and partly in Kline Township.The hearing begins at 7 p.m.
The East Union Township supervisors and a number of township residents are opposing the board from hearing the application claiming it should be brought before the newly formed township zoning hearing board. Kline Township has no zoning hearing board and comes under the jurisdiciton of the county board.
The township supervisors had sought the Schuylkill County Court to rule on jurisdiction but on Jan. 5 Judge John E. Domalakes handed down a ruling ordering the county zoning hearing board to conduct a hearing and make a decision on the issue prior to moving forward any further on the merits of the application.
Domalakes added,"This court will not entertain any further motions that are in any way related to the issue that have already been presented to the ocourt. A record of the applicability must be developed before the board. The appellate courts have ruled that there is a need for preservating the integrity of the zoning procedures and a desire to prevent he courts from becoming super zoning boards."
Gladstone wants to have the county boad hear the application and not the East Union Township's zoning hearing board which did not become an official board until the day after Gladstone had filed its application to the county.
