A Slatington man charged with the alleged rape of a female will have his case heard in Carbon County Court.

That was the ruling made against Justin Greene, 24, of 2822 Welshtown Road, Slatington, during a preliminary hearing Tuesday before District Judge Bruce Appleton of Palmerton.

Greene faced charges of rape by forcible compulsion; criminal conspiracy, rape; involuntary sexual deviate intercourse, criminal conspiracy, involuntary deviate sexual intercourse; sexual assault; criminal conspiracy, sexual assault; indecent assault; and criminal conspiracy, indecent assault.

Appleton dropped the criminal conspiracy charges. All the other charges were held for court.

At the prosecution's request, the media and others, except for the victim's mother, were asked to leave the courtroom before testimony due to the sensitive nature of the topic.

Greene is scheduled to appear before the Carbon County Court of Common Pleas at 9 a.m. May 12.

He was recommitted to Carbon County Prison in lieu of $100,000 bail.

According to the affidavit of probable cause filed by Michael R. Fedor of the Palmerton Borough Police Department:

Fedor was contacted by the Carbon County Communications Center on March 26 at 4:07 p.m. and requested to go to the Blue Mountain Health Systems Lehighton campus, according to the affidavit.

They were contacted and advised that a female had been admitted to the hospital reporting she had been raped, the affidavit says.

The victim stated that on March 25, she met a female companion at the Palmerton Hotel at about 10 p.m. While there, they met two white males, at which time the victim gave one of the males her cell phone/cell-phone number.

On March 26, at about 12:50 a.m., the victim and her female companion left the Palmerton Hotel. The males were picked up by another male. The victim followed her female companion to her residence to make sure she got home safe and went home.

The victim arrived at her residence at about 1 a.m., at which point she began to feel sick and vomited. Shortly after arriving home, the two males the victim had met at the Palmerton Hotel arrived at her residence and knocked on the door. The victim had not invited them to her apartment.

After speaking with them for a short time, the victim went to the bathroom, and upon exiting, found the two males in her bedroom. The next thing she remembers is the males being on top of her on her bed.

The two males were later identified as Justin Greene and another male. Greene and the other male removed the victim's clothing. Greene attacked her, while the other male was over top of her shoulders, which caused the victim to feel as though she couldn't sit up.

The victim repeatedly asked them to stop and get off her, but the assault continued. The victim next remembers waking up in her bathroom with Greene on top of her.

Greene then told the victim to get a shower. After the victim crawled out of the shower, she found that Greene and the other male had left.

She later checked her phone because she remembered one of the males had text messaged her. When she checked her phone, she found that the recent calls and text messages had been deleted.

A search warrant was executed on Cellco Partnership DBA Verizon Wireless for the cell phone/cell-phone number assigned to the victim. From these records, she was able to account for all but two text messages; those being a text message received on March 26 at 12:48 a.m. from another cell phone stating "What you we are coming to see you."

The second message, received on March 26 at 12:50 a.m. from another cell phone stated "Where do i go from the hotel?" The one cell number is assigned to the mother of the other male. A search of Pennsylvania operators licenses for the male returned two matches. The other cell number is assigned to another individual.

Fedor spoke with the male who picked up Greene and the other male. The male confirmed that he picked up two white males from the Palmerton Hotel in the early morning hours of March 26. He stated that one male was Greene, but he did not know the second male.

Photo lineups were prepared, including Greene, the other male, and another male. The victim positively identified Greene and the other male as the two males that she had met at the bar. She further stated that those were the same two males who assaulted her. She added that the second male had lost weight since the picture she viewed had been taken.

The victim's friend positively identified Greene and the second male as the two males they had talked to at the Palmerton Hotel.
