Lehighton man pleads to simple assault count

A Lehighton man, scheduled to pick a jury on Monday morning in Carbon County court, changed his mind and accepted a plea bargain offered by the district attorney's office and entered a guilty plea.

Scott A. Fisher, 37, pleaded guilty to one count of simple assault, by mutual consent, as a misdemeanor three before President Judge Roger N. Nanovic II.

Fisher was charged by Lehighton police with an incident that occurred Dec. 24, 2009, at an apartment along N. First St. He admitted striking Kelly Schroder, of the same apartment complex, over a pack of cigarettes.

Fisher admitted he was intoxicated at the time of the incident. Schroder told Nanovic that she was also drinking at the time. She also told Nanovic she wanted to drop the charges at the preliminary hearing but the DA's office refused.

Fisher has a criminal history, but the last arrest occurred in 1997, Nanovic noted.

In the plea agreement the DA dropped counts of aggravated assault and harassment and down-graded the simple assault charge from a misdemeanor two.

Nanovic placed Fisher on probation for a year and ordered he get a drug and alcohol evaluation and follow any recommendation for treatment and pay a reduced monthly supervison fee of $25 while on probation.
