Appeal filed to reverse township's rejection of land subdivision plan

Jude M. Gaydos, 602 Valley Road, Orwigsburg, filed an appeal in Schuylkill County court Friday seeking to reverse a decision by the East Brunswick Township supervisors, who rejected his plan for subdivision of land located off Township Route 751 (commonly referred to as Scenic Mountain Road).

In his appeal, Gaydos requested the court reverse the ruling of the township supervisors and enter an order directing them to approve the plan.

The premises in question, zoned as an agricultural district, include two parcels located off Scenic Mountain Road, containing 14.802 acres and 11.841 acres.

Last December, Gaydos filed with the board a subdivision and land development plan to create a 1.61 acre lot from the tract containing 11.841 acres. The plan was rejected with the board ruling it violated its Subdivision Regulations and Land Development Ordinance.

Gaydos claims the action by the board was vague, ambiguous and misleading. He claims his plan meets the requirements of the law.
