A Palmerton man, scheduled to go on trial before a judge on a charge of driving under the influence (DUI), Thursday, instead changed his mind and entered a guilty plea to the charge.

Brian Scott Scherer, 42, was scheduled to have a bench trial before Senior Judge Richard W. Webb but pleaded guilty instead. Scherer was arrested on Oct. 11, 2009, along SR209 in Franklin Township. A test revealed a .13BAC.

Webb accepted the plea and placed Scherer on probation for six months and ordered he pay a fine of $300 and get a drug and alcohol evaluation and follow any recommendation for treatment. He must also pay court costs and a $50 per month supervision fee while on probation.
