Couple ordered to begin jail term in theft case

A Pottsville couple, Robert M., 58, and Catherine M., 59, Whitney were ordered Monday by Schuylkill County President Judge William E. Baldwin to report to the county prison Saturday morning to begin a sentence of 11 to 23 months, make restitution of $10,000 to the victim, plus $22,650 for costs of expert witnesses brought in by the commonwealth at their trial.

On Dec. 11, 2008, a jury found both guilty of three counts of theft of monies from Louis V. Long, of Mahanoy City, during the year of 2005.

The delay in their sentence was caused because they had appealed the verdict to the state Superior Court, which recently handed down a decision denying their appeal and allowing the jury verdict to stand.

At the trial there was testimony that the money was obtained through a power of attorney granted Mrs. Whitney by Long in 2003. He died March 24, 2006.

Baldwin did grant Catherine Whitney permission to leave prison from 9 a.m. to 7 p.m. Monday through Friday to care for the couple's handicapped child, but denied the husband his request for immediate work release to keep his job with the post office in Reading.
