A Tamaqua woman entered a guilty plea in Carbon County court on Tuesday to a drug count and was told she faces a prison term at the time of sentencing.

She was one of 10 defendants in pending criminal cases who entered pleas before Judge Joseph J. Matika.Sold to agentLeslie Ann Napolitano, 27, pleaded guilty to one count of delivery of a controlled substance-morphine sulfate.She was arrested on July 19, 2012, after she sold the illegal substance to an undercover agent of the state Attorney General's office. The sale occurred in the area of 13 N. Walnut St., in Lansford.Matika told Napolitano that under state sentencing guidelines she faces a minimum prison term of between six and 12 months at the time of sentencing. He also said it could be in the county prison of a state prison.Sentencing was deferred because Napolitano has similar charges pending in Schuylkill County. Matika also ordered the adult probation office to prepare a presentence investigation report prior to sentencing.Other drug casesOther defendants facing drug charges entered pleas.Kyle Scherer, 26, of Palmerton, in two pending cases, pleaded to one count each of possession of a controlled substance-methamphetamine, and possession of a small amount of marijuana.He was arrested on the meth count on Dec. 3, 2013, by Mahoning Township police who responded to a report of a retail theft incident at the Wal-Mart store. On scene officers found Scherer sleeping in a vehicle believed to be part of the theft incident. Found in the car was crystal meth.The marijuana charge stems from an Aug. 20, 2013, incident in the area of 2045 E. Lizard Creek Road in Mahoning Township, during a vehicle stop.On the possession count Matika sentenced him to time served (99 days) to one year in jail. He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, and render 50 hours of community service.On the marijuana count he was fined $100.Stacey Lynn Stafiniak, 21, of Lehighton, pleaded guilty to one count of possession of a controlled substance-heroin.She was arrested on Aug. 29, 2013, by Mahoning Township police in the area of 234 Blakeslee Blvd., where police had responded to a report of a female threatening suicide. Stafiniak was that person.Sentencing was deferred.Ricky Allen Hunsicker Jr., 28, of Jim Thorpe, and formerly of Lansford, pleaded to one count each of possession of a controlled substance-heroin, and a summary offense of public drunkenness.He was arrested in the 300 block of W. Bertsch Street on July 5, 2013, by Lansford police following a report of an intoxicated male in the area.Hunsicker told Matika he is undergoing drug counseling to fight a heroin addiction.Matika placed him on probation for a year and ordered him to get a D&A evaluation, zero tolerance on D&A use, and render 50 hours of community service.On the summary count he was fined $100.J. Richard Litts, 59, of Nesquehoning, pleaded to one count of possession of drug paraphernalia. He was arrested on Nov. 27, 2012, at his residence at 127 W. Catawissa St. Police found drug paraphernalia in his apartment.Matika placed him on probation for six months and ordered he render 25 hours of community service.Daniel Thomas Leary Jr., 35, of Tamaqua, pleaded to one count each of possession of marijuana and possession of drug paraphernalia.He was arrested on Nov. 1, 2013, by Nesquehoning police following a traffic stop along Route 54.On the paraphernalia charge he was placed on probation for six months and ordered to render 25 hours of community service. On the possession count he was fined $200.Dennis L. Nedley Jr., 31, of Nesquehoning, pleaded to one count of possession of drug paraphernalia.He was arrested on Nov. 29, 2013, at 17 Holland St., by Nesquehoning police who responded to the area for a reported assault incident. He was found at the scene and in possession of the paraphernalia.Matika place him on probation for six months and ordered he render 50 hours of community service.DUI pleasThe following defendants pleaded to driving under the influence charges.Michael Serna, 19, of Dumont, N.J., was arrested on June 1, 2013, along Route 903 in Kidder Township by state police at Fern Ridge. Given a test, the result showed the presence of a controlled substance.He also pleaded to one count of possession of a small amount of marijuana.On the DUI count Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, and render 25 hours of community service. He was given credit for seven days already spent in jail on the charge and was paroled.On the drug count he was fined $300.Mark A. Guldin Sr., 42, of Philadelphia, was arrested on May 26, 2012, along Route 534 on the property at Hickory Run State Park after being involved in an accident. Given a test, the result was .17 BAC.Sentencing was deferred and Matika ordered the adult probation office to prepare a presentence investigation report.Terry Kemmerer, 51, of Lansford, was arrested on Oct. 27, 2012, along Route 209 by Lansford police, after being involved in an accident. Given a test, the result was .24 BAC, and also showed the presence of cocaine.Sentencing was deferred.Each defendant sentenced must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on probation of parole.
