Mill St., was charged by Nesquehoning Officer Carl Breiner with possession or delivery of a small amount of marijuana or hashish and possession of drug paraphernalia.According to an affidavit of probable cause on July 10, Breiner was dispatched to Volkers' address for a 911 hang-up call. He knew Volkers from pervious police contacts. When Breiner received the call he was talking with Agent Joseph Ruth of the state parole agency. Ruth also recognized the address, and agreed to meet Breiner there.Upon arrival they were met at the door by Volkers, who offered to let them inside. Breiner and Ruth saw, in plain view on top of an entertainment center, a small plastic bag with a pack of TOP brand cigarette rolling papers. Inside the bag was a smaller plastic bag with a small amount of green vegetable matter, which appeared to be marijuana. The bag was seized, and Volkers was asked about its contents. He said the green vegetable matter was marijuana and that it and the rolling papers belonged to him. The vegetable matter tested positive for marijuana.
