A Schuylkill County man, facing a homicide charge, was arrested by police in Carbon County at the county prison.
Daniel William Dull, 26, of Orwigsburg, was arrested by Nesquehoning Police Chief Sean Smith at the county prison and charged with failure to comply with registration requirements, under Megan's Law.
Dull is being held at the county prison on homicide and related counts filed by state police at Schuylkill Haven, in the death of a Schuylkill County man in May 2012.
Dull and Keith Allen Reber, 49, of Schuylkill Haven, were charged with tying Bryan Robert Smith, 26, of Orwigsburg, to a tree for 20 hours in extreme heat. Smith's body was found in a secluded area on the property of Reber. The body was found after Reber and Dull provided police with the location.
Smith filed the failure to register count after receiving information from the Schuylkill County Adult Probation office that Dull refused to sign registration forms incident to an act that took effect in December 2012. Dull was previously convicted of corruption of minors and placed on probation which runs through April 2015.
The Adam Walsh Act was passed by the state legislature which changed registration requirements in Megan's Law. Prior to the enactment of the new act Dull was not required to register as a sexual offender. However, since the act was passed, and its conditions are retroactive Dull is now required to register as a sexual offender.
Smith was informed by the probation office that Dull refused to sign the forms for his probation officer until he spoke with his attorney. The probation officer later notified Smith that Dull's attorney had sent a letter to him advising him he had to sign the registration forms, but Dull still refused.
On April 23 Smith met with Dull at the county prison and again advised him he had to register and showed him a copy of the letter his attorney mailed to him and the Schuylkill County probation office advising him he had to register.
Dull again refused to sign the forms and Smith filed the charge. Dull was arraigned before District Judge Casimir Kosciolek, of Lansford, and bail set at $2,000 straight cash. Dull was then returned to the county prison.
In addition to the homicide charge, Dull is also charged with unlawful restraint, kidnapping, aggravated and simple assault, recklessly endangering another person, and criminal conspiracy-to commit homicide.
Because of the homicide count no bail was set. Dull is in the Carbon prison to be separated from his co-defendant, Reber, who is in the Schuylkill County prison.
