Lansford man faces assault, drug charges

David Penberth, 42, of 315 E. Abbott St., Lansford, faces charges from an incident which took place on Sept. 8 at 315 E. Abbott St., Lansford. Charges of simple assault, possession of a small amount of marijuana, possession of drug paraphrenalia, and harassment were filed by Office Timothy Wuttke.

According to an affidavit of probable cause, here's what happened:Wuttke and Officer Jeff Ohl were dispatched to the home for a female who said she had been assaulted by her boyfriend.They arrived and met with the complainant, Stephanie Weirich, who was visibly upset and showed police bruises on her right arm and hand.She told police her boyrriend, Penberth, had assaulted her as they argued ovber marijuana. She said she wanted to "smoke a bowl," but that Penberth would not give her the marijuana, which led to the altercation. Weirich told police Penberth had a bag of marijuana in his pocket. She said this was an ongoing situation and that she could not deal with it any more.Wuttke then spoke with Penberth, who said he was sleeping and woke to find Weirich fighting with him. He said he grabbed her to push her away. Penberth was arrested, and police found a small bag of marijuana in a cell phone case in his pocket.He admitted that it was his. Ohl also found a pipe with burned residue next to a chair in which Penberth was seated.
