Hearings were held on seven summary appeals in Schuylkill County court from decisions rendered by magisterial district judges (DJ) with Judge Charles M. Miller upholding two appeals and denying five others who entered guilty pleas..
Greg Stanalonis, 21, of 435 W. Washington St., Frackville, won his appeal because the arresting officer, Patrolman Anthony Gallo, Butler Township police, failed to appear for the hearing.
Stanalonis appealed a $100 fine and costs after being adjudged guilty by a DJ of underage drinking. He was 20 years old at the time of his arrest last Oct. 2, 2011, when stopped on Beaver Dam Road in Butler Township.
The Commonwealth moved to dismiss the charge because it had no evidence to present and Miller granted the motion noting the officer failed to appear and made no request for continuing the hearing to another date.
Stanley I. Leonarczyk III, 32, of Ringtown, also won his appeal because the arresting police officer, Trooper Cazoni, failed to appear.
Leonarczyk was adjudged guilty by a DJ of traveling 85 miles per hour in a 65 zone on Interstate 81 in Butler Township last Feb. 12. The court ordered his fine of $80.50 and cost of $96 returned.
Daniel John Dutcavich, 55, of 212 Sunbury St., Minersville, changed his mind and pleaded guilty to a charge of driving while his license was suspended. Miller deferred sentence to Aug. 16 to allow Dutcavich undergo an evaluation. The DJ had adjudged him guilty and imposed a fine of $500 plus $98.02 costs.
Mary L. Hardy, 47, of 133 N. White St., Shenandoah, withdrew her appeal and entered a guilty plea to a charge of driving while her license was suspended. Miller placed her in the Intermediate Punishment Program (IPP) for 90 days under house arrest. The DJ had found her guilty of the charge and fined her $500 plus costs.
Gregory A. Sperlbaum, 44, of 310 W. Mahanoy Ave., Mahanoy City, withdrew his appeal and pleaded guilty to driving while his license was suspended. The fine of $500 plus $97.50 costs imposed by a DJ was upheld. Sperlbaum was cited by Rush Township police last Nov. 11 when stopped on Tuscarora Park Road (Route 1018).
Bruce M. Stine, 20, of 14 Hillside Road, Pottsville, withdrew his appeal and pleaded guilty to underage drinking and was fined $50 plus costs. He was adjudged guilty by a DJ and also was fined.
Stephen J. Bath, 43, of 502 W. Poplar St., Shenandoah, withdrew his appeal and pleaded guilty to driving while his license was suspended and was sentenced by Miller to pay a fine of $500 and $50 costs and to be placed under house arrest with electronic monitoring for 60 days and pay a $12 daily fee.
