Michael Kaspszyk, Eldred Township solicitor, reported that he received an update letter from Alpine Rose, dated Dec. 28, 2010 from Emil W. Kantra II, an attorney of Fitzpatrick Lentz & Bubba, representing Alpine Rose Resorts, Inc.
The letter states that Judge Krancer, the judge assigned to hear the Environmental Hearing Board trial case of the appeal taken by the Blue Mountain Preservation Association against Alpine Rose's NPDES Permit, canceled the trial date of Sept. 27 and directed a Settlement Conference for that date. During the conference Judge Krancer directed the BMPA and its consultant, Michele Adams, "to point out specific measures which she and the BMPA believe need to be implemented by Alpine Rose Resorts in order to address their concerns."
According to the letter, Alpine Rose incurred a substantial expense for additional engineering work in order to address the concerns raised at the conference "although we believe that our original storm water management design is more than adequate to address the regulartory requirements of DEP."
BMPA Attorney Kristl and Adams were provided with the analysis done by Alpine Rose's consultants over the following two months before the second Settlement Conference Dec. 9, 2010.
"When it became apparent to Judge Krancer at the time of the Dec. 9th Settlement Conference that a settlement would not likely occur despite the significant effort put forth by my clients to address the BMPA's concerns, he rescheduled the matter for trial to commence the week of Jan. 31, 2011."
Kaspszyk also received a letter from the Monroe County Planning Commission that everything was in order for a sign ordinance.
He also received the corrected covenant deed of the Jacqueline Mock property, which includes DCNR requirements and will file it in the Recorder's office.
Kaspszyk has received traffic studies from Hanover Engineering on Church Road to replace stop signs with yield signs. Supervisor Sharon Solt made a motion for Kaspszyk to compose a resolution for the supervisors to act on.
Supervisor chairman Clair Borger and township roadmaster reported that the road crew has been busy putting up about half of the new road signs needed since the readdressing of the township has been completed. He says he's ready to order the other half that is needed to complete the job.
The Kunkletown Vol. Fire Co. will be making and selling new address signs for Eldred residents at the firehouse every second Saturday of each month from 8 a.m.-1 p.m. The cost is approximately $18.
Supervisor Solt reported that Monroe County has had all tax books microfilmed and would no longer keep paper files of the old books from 1836-1959. Eldred's old real estate and occupational tax books are now safely stored at the township's municipal building.
Gretchen Gannon Pettit will be attending a grant workshop to learn how to write a grant.
Township real estate tax collector, Helen Mackes, requested a change of hours from night hours to that of the other municipal employee daytime hours. She would work two days a week and two Saturdays, starting with the fall school tax season. A motion was made by Solt for those hours to be adjusted and the board approved, 3-0.
At the Dec. 15, 2010 meeting, the supervisors approved two ordinances and two resolutions:
*Ordinance 2010-1 provides for the renaming of certain public and private streets and an emergency responders building numbering system (3-0)
*Ordinance 2010-2 authorizes volunteer fire companies and other emergency service providers to bill homeowners or other applicable insurance providers for services rendered (3-0)
*Resolution 2010-7 sets a 40-mile per hour speed limit for T-354, known as Upper 57 Road (3-0)
*Resolution 2010-8 appoints the firm of Kirk, Summa and Company to audit the 2010 Eldred Twp. Fiscal books in an amount not to exceed $4,750 (3-0)
The board adopted the proposed 2011 Eldred Twp. General Fund and State Fund Budgets (3-0)
Kaspszyk stated that on Dec. 1, 2010, the State Supreme Court denied Bruce Hawk's application to file an appeal of the case he has brought against Eldred Twp. and its adoption of the Zoning Ordinance concerning a description of what is a racetrack and what is a private club. He now has 30 days to appeal the denial.
