A Tamaqua man had charges related to sexual abuse bound over for court trial following a preliminary hearing Tuesday afternoon before District Judge Stephen Bayer, Tamaqua.

Kevin T. Gray, 53, of 142 Penn St., elected to have his preliminary hearing, which meant his five year old alleged victim was required to testify. Her testimony, as well as testimony provided by her grandmother and arresting officer Tamaqua Cpl. Henry Woods, was enough evidence to have all but one of the charges bound over for trial in Schuylkill County court.

According to the testimony, the victim was staying overnight at 142 Penn St., with her grandmother, on New Year's Eve. Gray also resides at that residence but is not related to his alleged victim. The child, her grandmother and Gray all stayed awake to watch the ball drop at midnight. All three then fell asleep downstairs.

The child said she was awakend by Gray, who lifted up her pajama top and pulled down her pajama bottoms. Gray then, according to testimony, licked her belly and private area.

Gray will face court trial on felony charges of involuntary deviate sexual intercourse with a person under the age of 16 and involuntary deviate sexual intercourse with a child less than 13, as well as misdemeanor counts of indecent assault without consent, indecent assault on a person less than 13 years of age, indecent assault on a person less than 16 and corruption of minors. A charge of forcible compulsion was dropped.

Gray remains free on $50,000 straight cash bail.
