A psychologist has been charged with sexually assaulting a female patient in his Mahoning Township office.
Michael T. Degilio, 41, of Dogwood Drive, Bear Creek Lake Estates, Penn Forest Township, was charged with involuntary deviate sexual intercourse, indecent assault, and indecent exposure.
He was arraigned yesterday before District Judge Edward Lewis of Jim Thorpe. Lewis set bail at $100,000 unsecured.
The alleged victim is a 39 year old Lehighton woman.
The charges were filed by officer Jeff Frace of the Mahoning Township Police Department following an investigation that began last March.
According to Chief of Police Kenneth J. Barnes, the initial complaint against Degilio was filed in the Mahoning Township Police Department on March 1, 2009.
Frace says that the victim was referred to Degilio for out-patient treatment by another doctor.
The victim, according to police, said she had two appointments with Degilio.
The first occurred on Feb.. 20, 2009 at 1 p.m., according to the affidavit. The second was on Feb. 24.
Police said the alleged victim told them that she met with Degilio because "she felt depressed, confused, vulnerable, and at time, suicidal."
According to the affidavit, at the first visit Degilio told her she was "too beautiful."
The affidavit says, "The female victim further stated that Degilio also remarked that if they did anything together, there could be no emotional attachment between the two of them."
The victim alleges that Degilio kissed her during the second visit, then exposed his private parts to her. In addition, it is alleged that Degilio had the victim perform oral sex on him.
Frace states in his report, "Before the female victim left Degilio's office, Degilio advised her his license was on the line, and she should not tell anyone. Degilio offered to return the female victim's $40 co-payment to her. She refused to accept it."
A hearing has been tentatively scheduled before Lewis on Wednesday.
