Monroe man faces charges after assaulting troopers

A Monroe County man is in jail for assaulting troopers while being taken into custody for driving under the influence.

John William Tutko, 52, of Kunkletown, faces charges on four counts each of aggravated assault, simple assault, resisting arrest or other law enforcement, and harassment.According to the affidavit filed by trooper Eric Porpiglia of the Troop N Fern Ridge Patrol Unit:At 7:44 p.m. Thursday, state police were dispatched to an erratic driving call at 5157 Hickory Lane in Chestnuthill Township.The caller said that a black Jeep Compass was driving erratically and was traveling in the opposite lane of traffic on numerous occasions, weaving on the road and going off into the grass.The woman said she followed the vehicle and watched it park in the driveway at 5157 Hickory Lane, and she saw a man stumble out of the vehicle and enter the residence.Trooper Jonathan Hontz knocked on the front door. A man answered and several troopers entered the residence.The other man inside the house, Tutko, said he was driving the Jeep Compass and just got home from work.Trooper Nicholas Mantione immediately smelled the odor of alcohol coming from Tutko and asked him to step outside and perform field sobriety tests, which Tutko failed.Mantione attempted to place Tutko in handcuffs, and he began pushing away.Several troopers tried to gain control of Tutko to place him under arrest, but Tutko continued to resist and kicked trooper Matthew Kizis five times in the right leg and one time in the groin.The troopers placed Tutko on the ground to attach leg restraints, and Tutko kicked troopers George Tessitore and Hontz in the leg one time.Once the troopers were able to place Tutko in the leg restraints and handcuffs, he attempted to spit on all four troopers.The troopers carried him to their state police vehicle, and he began kicking and attempted to spit on the troopers.While inside the vehicle, he kicked Mantione three times in the right thigh and was attempting to spit inside the vehicle.Tutko then said he knew that he was HIV positive.He was then transported to the Pocono Medical Center for a laceration to his head, and for a blood test.Tutko was unable to post bail and was taken to the Monroe County Correctional Facility in lieu of $10,000 bail.He is scheduled to have a preliminary hearing at 10 a.m. Friday before District Judge Colleen Mancuso of Brodheadsville.
