Man admits assault involving his mother

A Carbon County man, scheduled for trial this week in the county court, instead entered a guilty plea to a count of simple assault with his mother the listed victim.

Michael John McFadden, 28, of Nesquehoning, pleaded guilty to the charge before Judge Joseph J. Matika. A summary offense of harassment was dismissed.McFadden was charged by Nesquehoning police for an incident on Dec. 19, 2015, at the residence of his mother. The two got into an argument over his request to use her vehicle, which she didn't want him to use. At some point the verbal argument turned physical and he assaulted his mother.Defense attorney Gregory Mousseau, of the public defender's office, told Matika that McFadden and his mother still have a good relationship, noting she was in the courtroom for the plea proceeding. He added that McFadden never intended to harm his mother and that he "just lost his cool."McFadden told the court he was "very sorry" for what happened.Matika accepted the plea and immediately sentenced him to serve six to 12 months in the county prison with credit for 48 days already served. McFadden is currently an inmate in the state correctional institution at Mahanoy, Schuylkill County, awaiting action of a state parole violation filed against him. After he deals with the state action he will then be transferred to the county prison to begin the new sentence.Matika also ordered him to pay court costs of about $1,000, a $50 per month supervision fee and render 25 hours of community service when he is released on parole.
