Carbon County court

A Carbon County man pleaded guilty Monday morning to a threats charge.

He was one of six defendants in pending criminal cases to enter a guilty plea before Judge Steven R. Serfass.

Lansford incident

Joseph Nicholas Kamant

, 27, pleaded to one count each of terroristic threats and possession of drug paraphernalia.

He was arrested by Lansford police for an incident on May 16. Police responded to a West Patterson Street residence for a reported threats incident. On scene, two female victims said Kamant threatened them, including threatening to kill one of them. Drug paraphernalia was found on Kamant when taken into custody.

On the threats count, Serfass sentenced Kamant to time-served (12 days) to 23 months in prison, and on the drug charge one year probation, with the terms running consecutively.

He was also ordered to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, zero tolerance for drug or alcohol use, have no contact with the victims and render a total of 150 hours of community service.

Other pleas

Heather Ann Lupcho

, 32, of Lansford, entered pleas in two pending cases to one count of theft and one count of theft by deception.

She was arrested on the theft count on Feb. 27 by Mahoning Township police for taking money of a female at the Walmart store. The female had gone through the self-checkout area and requested change while using a credit card. The woman left the money at the checkout area, and when she returned a few minutes later the money was gone. Video surveillance showed Lupcho taking the money.

The deception count was filed by Mahoning Township police for another incident at the Walmart store. Lupcho entered the store, took items from a shelf then attempted to return them for cash using a receipt from the Tamaqua Walmart store.

Serfass placed her on probation for a year on each count, running consecutively, and ordered her to make restitution of $67.26 to Walmart and $60 to the victim in the theft case. She was also ordered to render a total of 100 hours of community service.

Derek Michael Kleppinger

, 28, of Jim Thorpe, pleaded to one count each of possession of drug paraphernalia, driving under suspension and no inspection sticker.

Kleppinger was arrested following a vehicle stop by Summit Hill police on March 12.

On the drug count, Serfass placed him on probation for a year and ordered he get a drug and alcohol evaluation and render 50 hours of community service.

On the suspension count, he was fined $200 and on the inspection sticker charge he was fined $25.

Shana Kunkle

, 41, of Weatherly, pleaded to one count each of accidents involving damages to attended vehicle or property and a summary offense of careless driving.

She was arrested on Nov. 9, 2018, by Weatherly police. Police responded to an area along Plane Street for a vehicle off the road in a ditch. On scene, the vehicle was found but no driver. Through an investigation, police learned Kunkle was the driver and had left the scene.

On the accidents count, Serfass placed her on probation for a year and ordered her to render 50 hours of community service. On the summary count she was fined $25.

Stacey Miletto

, 43, of Summit Hill, pleaded to one count each of possession of a small amount of marijuana and driving under suspension.

She was arrested on April 13 by Summit Hill police following a vehicle stop.

On the marijuana count, Serfass imposed a fine of $300 and on the suspension charge a fine of $500.

Benjamin Franklin Williams

, 34, of Lehighton, pleaded to one count of possession of a small amount of marijuana.

He was arrested by Lehighton police on Aug. 26, 2018, following an incident at a residence along North Second Street. Police responded to the area for a report of a home invasion. On scene, police learned that a juvenile female was walking home with Williams following her. He attempted to speak to her, which the girl ignored and began to run. Williams followed her to her home, at which point the victim’s mother opened the door to let her daughter in and blocked Williams from entering the home.

Police found Williams walking in the area and took him into custody. In exchange for the plea, charges of simple assault, defiant trespass, harassment and public drunkenness were dropped by the district attorney’s office.

Serfass imposed a fine of $300.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
