Borough police identified the suspect as Cody Scott Kmetz, 24, of 3 Second Ave.The first incident occurred on May 1 when Kmetz's mother, Rosalie, arrived at the police station to report her son was using heroin and was out of control at the home, causing damages. An investigation conducted by police and county drug agent Jeff Aster revealed Kmetz was not only a user, but a seller of heroin. The sales he made were to support his own habit.Police went to Kmetz's home and found her son inside. He admitted using about 15 bags of heroin that day and gave consent for a search his bedroom. Found were various drug paraphernalia such as glass bowl, digital scale with white powder, baggies with heroin residue, a notebook used as an "owe sheet" and other items. As a result, Chief Sean Smith charged Kmetz with possession with intent to deliver a controlled substance, possession and possession of drug paraphernalia. The second incident occurred on Sept. 11 when police received a call from Kmetz's father, Scott Kmetz, who said his son was back on heroin and he feared he was going to harm himself at his residence.Smith and officer Richard Neikam responded to the home and observed Cody Kmetz exiting a tool shed on the property. In speaking with the suspect, police learned he was using heroin again at a rate of 30 bags a day.Smith then asked Kmetz if there were drugs in the shed he was observed leaving, to which he did not respond. Rosalie Kmetz gave police permission to search the shed. Drugs and drug paraphernalia were found in the shed.As a result, police charged him with additional counts of possession with intent to manufacture or deliver a controlled substance, possession and possession of drug paraphernalia. He was arraigned on all the charges and released on unsecured bail.A preliminary hearing is scheduled for 1:45 p.m. Nov. 18 in front of District Judge Casimir Kosciolek.
