Court holds revocation hearings

Carbon County judges conducted parole/probation revocation hearings on petitions filed by the adult probation office against defendants who violated the conditions of their release.

Those who had hearings included:Ashley Matz, 21, of Jim Thorpe, had her parole revoked on a charge of possession of a controlled substance on petition of probation officer Joseph Bettine for violating conditions by not making a concerted effort to pay her court costs, and not completing 50 hours of community service.President Judge Roger N. Nanovic resentenced her to serve three months back time in the county prison effective June 1 at 9 a.m. However, if she completes the community service time and pays $175 on her court costs while making her regular monthly payments, the order will be vacated.Bethann Neff, 27, of Nesquehoning, had her parole revoked on charges of criminal trespass and theft on petition of probation officer Clifford Eckhart for violating conditions by testing positive for a controlled substance, which violated the zero-tolerance provision.Judge Steven R. Serfass resentenced her to serve the balance of her original sentence in the county prison which runs to March 28.Ashley Roberts, 30, of Lansford, had her parole revoked on a charge of criminal use of a communication device on petition of Eckhart for violating conditions by testing positive for a controlled substance, failing to submit to a scheduled drug screen, which violated the zero-tolerance provision.Nanovic resentenced her to serve 45 to 90 days in the county prison. The order states she must serve the full 90 days, with credit for 49 days already served.Felicia Bigg-Carr, 24, of Coaldale, had her parole revoked on a charge of simple assault on petition of Eckhart for violating conditions by testing positive for a controlled substance, which violated the zero-tolerance provision, failing to attend and complete drug and alcohol treatment, and failing to complete 100 hours of community service.Judge Joseph J. Matika resentenced her to serve 80 days back time in the county prison effective Feb. 20.Kyle Hagenbuch, 21, of Nesquehoning, had his parole revoked on a charge of terroristic threats on petition of Eckhart for violating conditions by residing at an unapproved residence and being charged with new criminal offenses.Serfass resentenced him to serve 269 days in the county prison, which runs concurrent with a prior sentence imposed by the court, and also to serve eight to 17 months in prison on a theft count, which runs consecutive to the threats charge. He was given credit for 183 days already served.Phillip Thompson, 45, of Summit Hill, had his parole revoked on a charge of possession of a controlled substance on petition of Eckhart for violating conditions by testing positive for a controlled substance which violated the zero-tolerance provision.Matika resentenced him to serve 60 days in the county prison with credit for 29 already served.David Miller, 27, of Weatherly, had his probation revoked on a charge of theft on petition of Bettine for violating conditions by testing positive for alcohol, which violated the zero-tolerance provision, and failing to submit to a scheduled urine screen.Matika resentenced him to serve 45 days to 14 months in the county prison effective Jan. 27.Laurie Maguschak, 51, of Beaver Meadows, had her probation revoked on a charge of receiving stolen property on petition of Bettine for violating conditions by testing positive for opiates, which violated the zero-tolerance provision.Matika resentenced her to serve 30 days to 22 months in the county prison. which was effective Jan. 21.Jeffrey Dolinsky, 51, of Weatherly, had his parole revoked on a driving under the influence charge on petition of Bettine for violating conditions by admitting to consuming alcohol, which violated the zero-tolerance provision, and missed a scheduled urine screen.Matika resentenced him to serve 73 days to 24 months in the county prison followed by three years of probation. He was given credit for 65 days already served.ARDs revokedThe following defendants had their placement in the Accelerated Rehabilitation Disposition probation program revoked.Michael Smith Jr., 23, of Albrightsville, was placed in the program on a charge of possession with intent to deliver a controlled substance. He was revoked on petition of Bettine for violating conditions by failing to pay court costs and not completing 100 hours of community service.Nanovic ordered therevocation effective on June 1. If Smith pays in full his court costs and completes the 100 hours of community service by thatdate, the order will be vacated.Greg Vandermartin, 29, of Nesquehoning, was placed in the program on charges of possession of marijuana and possession of drug paraphernalia. He was revoked on petition of Eckhart for violating conditions by testing positive for a controlled substance which violated the zero-tolerance provision.Matika ordered the case be placed on the next available trial list.
