Parole, probations revoked

Several defendants under supervision of the Carbon County Adult Probation Department had their parole or probations revoked on petitions filed by the probation office for violating the terms of their release.

Hearings on the petitions were conducted by the county judges with the following results:Shawn Filchner, 44, of Palmerton, had his probation revoked on a charge of bad checks on petition of probation officer Kimberly Cooper for violating conditions by being arrested by Whitehall Township police on Oct. 7 for retail theft.Judge Steven R. Serfass resentenced him to serve six to one day less 24 months in the county prison with the effective date of Nov. 24, 2014.Jennifer Coxe, 40, of Conyngham, Luzerne County, had her probation revoked on a charge of driving under the influence on petition of probation officer Joseph Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete 25 hours of community service.Serfass resentenced her to serve three months of back time effective Aug. 3 at 9 a.m. However, if by that date she completes the community service time and pays $308 in court costs, plus her regular monthly payments, the order will be vacated.Felicia Urbanski, 27, of Tamaqua, had her parole revoked on a charge of retail theft on petition of probation officer Clifford Eckhart for violating conditions by failing to report to the probation office as directed, absconding from her approved residence and being charged with a new criminal offense.Judge Joseph J. Matika resentenced her to serve the balance of her sentence in the county prison which runs to June 30.Jamie Taschler, 24, of Lehighton, had his parole revoked on a charge of access device fraud on petition of probation officer Toby Butz for violating conditions by admitting using heroin, Ativan and Suboxone, which violated the zero-tolerance provision.President Judge Roger N. Nanovic II resentenced him to serve the balance of his sentence in the county prison which runs to Aug. 24.Gina Miller, 36, of Lehighton, had her probation revoked on a charge of possession of a controlled substance on petition of probation officer Jillian C. McGinley for violating conditions by admitting using about three to four bags of heroin, which violated the zero-tolerance provision, and associating with another defendant.Matika resentenced her to serve 90 days to 12 months in the county prison effective Jan. 29.Jennifer Steigerwalt, 32, of Lehighton, had her parole revoked on a charge of possession with intent to deliver a controlled substance on petition of McGinley for violating conditions by testing positive for opiates, which violated the zero-tolerance provision.Nanovic resentenced her to serve six months in the county prison effective Jan. 21.Michael Lower, 38, of Lansford, had his probation revoked on a charge of possession of drug paraphernalia on petition of Eckhart for violating conditions by testing positive for a controlled substance, which violated the zero-tolerance provision.Nanovic resentenced him to serve 45 to 90 days in the county prison. The court ruled he must serve the 90 days.Daniel Hollan, 32, of Lansford, had his parole revoked on a charge of possession with intent to deliver a controlled substance on petition of Eckhart for violating conditions by testing positive for a controlled substance, which violated the zero-tolerance provision.Matika resentenced him to serve the balance of his sentence in the county prison which runs to May 7.Robin Hosier, 52, of Lansford, had her parole revoked on a charge of DUI on petition of Eckhart for violating conditions by testing positive for a controlled substance, failing to complete the alcohol highway safety program, failing to complete drug and alcohol treatment, and failing to perform 25 hours of community service.Matika resentenced her to serve 90 days of back time in the county prison.Sean McFadden, 25, of Nesquehoning, had his parole revoked on two cases involving a charge of possession of a controlled substance in the first case and theft by unlawful taking in the second case on petition of Eckhart for violating conditions by not having a suitable residence and being charged with a new criminal offense.Serfass resentenced him to serve 12 months of back time on the theft count and six months of back time on the drug charge. Since he has already served the time imposed, he was paroled.Alan Kovacs, 26, of Stanhope, New Jersey, had his parole revoked on a charge of DUI on petition of Bettine for violating conditions by failing to complete 25 hours of community service.Matika resentenced him to serve four months back time in the county prison effective Feb. 4.Kody Christman, 23, of Albrightsville, had his probation revoked on a retail theft charge on petition of Bettine for violating conditions by not residing at his approved residence, failing to make a concerted effort to pay court costs with an outstanding balance of $1,450.78, and failing to complete 50 hours of community service.Matika resentenced him to serve four to eight months in the county prison effective Jan. 23.ARD revokedTwo defendants previously placed in the county's Accelerated Rehabilitation Disposition probation program were revoked for violating conditions.William Dougherty, 29, of Pocono Lake was revoked on a possession of drug paraphernalia charge on petition of Bettine for violating conditions by failing to pay court costs, and failing to complete 50 hours of community service.Matika ruled the revocation is effective July 1. If he completes the community service and pays all court costs in full by that date, then the revocation order will be vacated. Otherwise, his case will be placed on the next available trial list.Shelby Wentz, 22, of Nesquehoning, was revoked on a charge of burglary on petition of Eckhart for violating conditions by failing to pay court costs and failing to complete drug and alcohol treatment.Nanovic ruled the case be placed on the April 30 pretrial list.
