Palmerton Council approves subdivision plan

Plans were finalized for an existing Dunkin' Donuts shop and neighboring property in Palmerton.

On a 6-0 vote Thursday, council granted conditional approval on a subdivision plan, as well as a lot line adjustment plan, for the properties at 555 Delaware Ave.Also as part of its action, council made a motion that both plans must be recorded together to amend each other.Located at the former Bennett Palmerton dealership, the property also serves as a medical office for Blue Mountain Health System's family practice physician Dr. Syed Zia. The back end has served as a Carbon Lehigh Intermediate Unit facility since 2010.Council President Terry Costenbader said the borough's planning commission met Wednesday to review the plan, along with some comments from the Carbon County Planning Commission.Costenbader said the borough planning commission recommended that council conditionally approve the subdivision plan upon council's granting of the waivers and addressing concerns from the borough engineer's letter.Council then agreed to grant three waivers for the final land development plan.Joseph Bennett then addressed council."This problem wasn't created by me; this problem's been created by (borough zoning officer Duane) Dellecker, thinking this was a big deal," Bennett said. "I own both properties."After the meeting, borough Manager Rodger Danielson said the fault doesn't rest with Dellecker."The building was not built as originally designed, and crossed the property line," Danielson said.Bennett said he would do whatever needs to be done to complete the work.A question then came up about the payment for the initial permit, which Bennett said he made.Danielson said the prior permit was closed because work under that permit was completed.Bennett then asked, "What's the logic behind withdrawing my development plan?"Danielson said council had previously granted several time extensions, and felt it was time to stop granting extensions and either approve, or disapprove, and that the plan at that time was not ready for approval.In May, council rejected a pair of land development plans at the site based on compliance of the Municipalities Planning Code, as well as the borough engineer's review of the Subdivision and Land Development Ordinance.That action came after council met with Bennett in March concerning the property, and after council in February granted Bennett an extension.In other business, council:• Held a moment of silence in observance of the 13th anniversary of the 9/11 attacks.• Accepted, on a 6-0 vote, with Councilman Jason Behler absent, the resignation of part-time police officer Bruce Boyles. Boyles accepted a full-time position with the Lehighton Borough Police Department.• Agreed to allow the Christian Action Council of Palmerton Area Churches conduct a Crop Walk at 1:30 p.m. Oct. 12.
