Walnutport man gets county time after police chase

A Walnutport man pleaded guilty to a charge of fleeing and eluding police and was sentenced to a county prison term on Tuesday.

He was one of seven defendants in pending criminal cases to enter a plea before President Judge Roger N. Nanovic II.Mahoning incidentJames Joseph Shelak II, 43, was arrested following an incident on Oct. 2 in Mahoning Township.Officers observed two motorcycles traveling along Route 209 toward Lehighton and crossing the center and fog lines.Police initiated a stop and one of the cyclist pulling over while the other sped off.A chase ensued in which the cyclist, later identified as Shelak, ran stop signs before finally being stopped.He told officers he had two outstanding warrants for his arrest and that was why he fled. He was also originally charged with DUI, but that count was dropped, he said, because the test result showed no alcohol or drugs in his system. Police did find heroin on him.Nanovic sentenced him to serve four to one day less 24 months in the county prison. He was also ordered to pay a fine of $500, get a drug and alcohol evaluation and follow any recommendation for treatment and make restitution of $400 for damages to a township vehicle.The prison term runs concurrent with a jail term he is currently serving on other charges.Other pleasOther defendants entering pleas included:Nickolas J. Klingel, 24, of Kresgeville, pleaded to one count each of criminal trespass, as a felony three, and a summary offense of criminal mischief.He was arrested on June 7 by state police at Lehighton for an incident at Blue Ridge Towing, located at 505 Little Gap Road, in Lower Towamensing Township.He entered a building on the property by smashing a window. A vehicle he was previously driving was towed to that location following another incident.He said he went to retrieve items from it, including some heroin, which he claimed was not his but he was getting for a person who was in the vehicle with him at the time.Klingel, a veteran, told Nanovic he was suffering from post traumatic stress due to his military service and is being treated for it.On the trespass count Nanovic sentenced him to serve one to 12 months in the county prison with credit for 21 days spent in a drug inpatient program. He was also ordered to get a drug evaluation, supply an DNA sample, and make restitution of $525. On the summary offense he was fined $300.He will begin his jail term at noon on Dec. 13.Brandon M. Kuklentz, 21, of Lehighton, pleaded to one count of criminal trespass.He was arrested by Franklin Township on June 18 for an incident at 1017 Main Road.Police responded to a report of a burglary in progress. Police found Kuklentz had entered the home of his father after previously being told he was not allowed there.Nanovic placed him on probation for six months and ordered he get a D&A evaluation.Jennifer M. Walker, 36, of Palmerton, pleaded to two counts of retail theft.She was arrested on the first count on April 5 by Palmerton police at the Rite Aid pharmacy. The second theft occurred on June 29 at the Family Dollar Store, also in Palmerton. Items totaling $184.13 were taken, but have been recovered.Nanovic placed her on probation for a year on each count, running concurrently, and further ordered she get a mental health evaluation.Nicolas E. Martini, 29, of Saylorsburg, pleaded to one count of receiving stolen property.He was arrested on Jan. 26 by state police at Lehighton for taking a set of skis at the Blue Mountain Ski Resort in Lower Towamensing Township. The skis were recovered.Nanovic placed him on probation for a year and ordered he get a drug evaluation and zero tolerance imposed for D&A use.Michael John Dulina, 33, of Weatherly, pleaded to one count of operating a vehicle without interlock system as required.He was arrested at a DUI checkpoint along Route 209 in Mahoning Township on Aug. 14. A check by police of his driving record indicated he was required to have the system on his vehicle due to a DUI conviction. He claimed he had the interlock system on another vehicle and was en route to have it transferred to the vehicle he was driving, when stopped.Nanovic placed him on probation for 90 days and ordered he pay a fine of $300.David M. Hanley, 39, of Bangor, pleaded to one count of receiving stolen property.He was arrested on July 7 by state police at Lehighton for an incident at the Alliance Sand Company property at 416 Golf Rd., in Lower Towamensing Township. He admitted having an anvil stolen from the company, in his possession.Nanovic placed him on probation for six months and pay a fine of $1,000.Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
