A petition was filed Friday in the Schuylkill County Court to recount the ballot box in Schuylkill Township for the office of supervisor.
The official results of the Municipal General Election held Nov. 5 shows Charles J. Fayash, Republican, won over Linda A. Decindio, Democrat by one vote. Fayash received 188 votes and Decindio 187 votes. There was one write-in vote listed as 'scattered,' meaning non associated with any person.
Under the election law neither candidate would have been allowed to count a writein vote because both were listed on the ballot and only the votes cast besides their names could be counted, according to the election code. This is to prevent double dipping of a person voting for a candidate whose name is listed and then going to the write-in section and casting a second vote for the candidate.
In the petition filed to court it states the petitions are qualified electors from the village of MaryD and upon information which they consider is considered reliable they believe that fraud or error, although not manifest on the general return of the votes made from the voting machine, was commited in the computation of the votes cast for the office of township supervisor or in the marking of the ballots or otherwise in connection with the final tally of qualified votes.
Schuylkill Township has only one voting precinct and it is located in Sheppton Village.
