Carbon defendants who violated release provisions have hearings

Defendants who violated the terms of their probation or parole had petitions filed against then by the Carbon County Adult Probation office and were resentenced by county judges.

They included:Felicia Bower, 25, of Nesquehoning, had a petition to revoke her parole filed by probation officer Clifford Eckhart on a charge of involuntary manslaughter.On May 18, 2012, President Judge Roger N. Nanovic II resentenced her to serve six to one day less 24 months in jail on the charge. She was given credit for 56 days spent in jail on the charge. On Sept. 23, 2012, she was placed on parole.The petition states she violated her paroled by testing positive for a controlled substance-cocaine, and violated the zero tolerance provision.Bower did not contest the petition and on July 2 was recommitted to the county prison by Judge Nanovic to serve out her maximum term, which runs to March 22, 2014.Jeffrey Tee, 24, of Summit Hill, had a petition filed by Eckhart to revoke his parole on a charge of possession of drug paraphernalia.He was charged with violating the following conditions: failed to report to the adult probation office as directed; was charged with a new crime; failed to submit scheduled drugs screens; violated zero tolerance provision; and failed to attend and complete drug and alcohol treatment.Tee did not contest the petition and on July 2 Judge Steven R. Serfass recommitted him to the county prison to sere 146 days. He was given credit for 104 days and was granted work release privileges.Tee had a second petition filed by Eckhart to revoke his parole on a charge of simple assault. The same sentence was imposed with the same credit.Christopher Field, 21, of Summit Hill, had a petition filed by Eckhart to revoke is probation on a charge of possession of drug paraphernalia. He violated conditions by failing to report to the probation office as directed; he was charged with a new criminal offense; and failed to submit to scheduled drug screens.He did not contest the petition and on July 2 was resentenced by Judge Joseph J. Matika to serve five to 10 months in the county prison. He was given credit for 148 days spent in jail to date on the charge.David Horack, 26, of Lansford, had a petition filed by Eckhart to revoke his probation on a burglary charge. He violated condition that he absconded from his approved residence and his whereabouts were unknown.He did not contest the petition and was resentenced by Judge Serfass on July 2 to serve 125 days to 10 months in prison with credit for 125 days already served.Ian Curtis, 26, of Lansford, had a petition filed by Eckhart to revoke his probation on a charge of possession of a controlled substance. He violated his probation by testing positive for a controlled substance and violating the zero tolerance provision.He did not contest the petition and was resentenced by Judge Matika on July 9 to serve three to six months in the county prison with credit for 30 days already served. The court order also states that he will not be released on his minimum date, but must serve the balance of his sentence, which runs to Dec. 10.Jeffrey David Boyer, 48, of Lansford, had a petition filed by Eckhart to revoke his parole on a charge of persistent disorderly conduct. He violated conditions by failing to report to the probation office as directed; absconded from his approved residence and his whereabouts were unknown; was charged with a new criminal offense; and failed to obtain a drug and alcohol evaluation as ordered.Judge Serfass found him in violation and on July 11 resentenced him to serve five months back-time in the county prison, with credit for 66 days already served.James Duffy, 35, of Beaver Meadows, had a petition filed by probation officer Joseph J. Berke for violating his Intermediate Punishment Program (IPP) placement. He violated the program by leaving his residence without the prior permission of his probation officer.Duffy did not contest the petition and on June 19 Judge Matika resentenced him to serve 50 days to six months in the county prison effective June 12.Ehabb Elsayed, 27, of Effort, had a petition filed by Berke to revoke his probation on charges of retail theft and theft by deception. He violated conditions by possessing a controlled substance and drug paraphernalia.Elsayed did not contest the petition and on June 19 Judge Serfass resentenced him as follows: on retail theft count two to six months in the county prison and on the theft count, two to six months in the county prison, with the terms running consecutively.Joseph Hudock, 23, of Thornhurst, Lackawanna County, had a petition filed by probation officer Matthew J. Kimmel to revoke his parole on a charge of driving under the influence (DUI). He violated conditions by failing to complete a drug and alcohol program and failed to complete 25 hours of community service.On July 11 Judge Matika ruled he violated the conditions and recommitted Hudock to the county prison to serve 90 days back-time effective Dec. 1 at 9 a.m.Alisen Vanger, 24, of Tamaqua, had a petition filed by Eckhart to revoke her parole on a charge of possession of a controlled substance. She violated conditions by testing positive for a controlled substance-opiates, and violated the zero tolerance provision.She did not contest the petition and on July 2 was resentenced by Judge Matika to serve the balance of her maximum term which runs to Sept. 26.Amanda Reed, 22, of Jim Thorpe, had a petition filed by Eckhart to revoke her parole on a charge of possession of drug paraphernalia. She violated conditions by failing to complete a drug and alcohol program.She did not contest the petition and on July 2 was resentenced by Judge Matika to serve 18 days back time in the county prison.Leonard Ruggiero, 21, of Coaldale, had a petition filed by Kimmel to revoke him from the county's Accelerated Rehabilitation Disposition (ARD) probation program by failing to pay court costs and failed to complete both anger management counseling and community service time. He was placed on a simple assault charge.On July 11 Judge Matika revoked him from the program and ordered the case placed on the pre-trail list. However, it was deferred pending the completion of the following by Ruggiero: he complete the community service work and anger management classes and pay all costs in full by Nov. 1. If he does, then the revocation order will be vacated.
