Sixteen first time offenders were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Monday by President Judge Roger N. Nanovic II.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they failed to complete it, or are revoked from it, the Commonwealth reserves the right to prosecute them on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Rosemarie Austin, 70, of Lehighton, was placed on a driving under the influence (DUI) charge. She was arrested on June 11, 2012, along Mahoning Mountain Road by Mahoning Township police. Given a test, the result showed the presence of a controlled substance.

She was assessed $600 for the cost of the program, and ordered to get both a drug and alcohol (D&A) and mental health evaluations and follow any recommendations for treatment, and her license was suspended for 60 days.

Charissa M. Butchko, 28, of Summit Hill, was placed on a DUI charge. She was arrested on May 26, 2012, along Mill Road by Mahoning Township police. Given a test, the result showed the presence of a controlled substance.

She was assessed $600, and ordered to get a D&A evaluation, restitution of $3,620.46 to PPL Utilities for a pole damaged in an accident, and license suspended for 60 days.

Ayla B. Hoffman, 22, of Lehighton, was placed on a DUI charge. She was arrested on July 30, 2012, along SR209 by Jim Thorpe police. Given a test, the result showed the presence of a controlled substance.

She was assessed $600, and ordered to get a D&A evaluation, and license suspended for 60 days.

Rosemary Lane, 58, of Jim Thorpe, was placed on a charge of possession of a small amount of marijuana. She was arrested on Jan. 29, 2012, following a vehicle stop along SR209 by state police at Lehighton, in Lehighton.

She was assessed $450, and ordered to get a D&A evaluation.

Michael Anthony Regina, 21, of Sewell, N.J., was placed on a DUI charge. He was arrested on Oct. 27, 2012, by state police at Lehighton, along Fourth St., in Jim Thorpe. Given a test, the result was .17BAC.

He was assessed $550, and ordered to get a D&A evaluation, and license suspended for 60 days.

Albert Samanns, 65, of Jim Thorpe, was placed on a charge of aggravated assault. He was arrested by state police at Lehighton for an incident on Sept. 9, 2012, in Penn Forest Township with his 15-year-old daughter the listed victim.

He was assessed $450, and ordered to render 25 hours of community service, attend and complete a anger management course, and have no contact with the victim until approved by the probation office.

Christy Lynn Stay, 35, of Palmerton, was placed on a DUI charge. She was arrested on July 30, 2012, at Parker Mew and Wiley Circle, in Penn Forest Township, by state police at Fern Ridge. Given a test, the result was .19BAC.

She was assessed $550, and ordered to get a D&A evaluation, and license suspended for 60 days.

Gabriel L. Summa, 42, of Wilmington, Del., was placed on a DUI charge. He was arrested on Oct. 13, 2012, along Lehigh Avenue by Jim Thorpe police. Given a test, the result was .09BAC.

He was assessed $600, and ordered to get a D&A evaluation, and license suspended for 60 days.

Tommie Jane Summers, 41, of Lehighton, was placed on a charge of terroristic threats. She was arrested on Oct. 9, 2012, by Mahoning Township for what police said was a domestic incident with Greg Ward the listed victim.

She was assessed $450, and ordered to get both a D&A and mental health evaluations.

Jimmy Joseph Woodby, 18, of Tobyhanna, and formerly of Jim Thorpe, was placed on three pending cases - two of theft and one of access device fraud, all occurring on Oct. 1, 2012, in Jim Thorpe, and at three different locations.

He was assessed $450, and ordered to get a D&A evaluation, render 25 hours of community service, and make restitution in an amount to be determined by the adult probation office.

Hansel Jose Almanzar, 35, of Allentown, was placed on a charge of incapable of operating a watercraft after inbibing alcohol. He was arrested by fish and game officers for an incident on Aug. 12, 2012, at Beltzville Lake in Franklin Township.

He was assessed $500, and ordered to get a D&A evaluation, his watercraft privileges suspended for six months, must render three hours of community service per month while in the program, and must attend boating safety classes.

Devin John Dunwoodie, 34, of Palmerton, was placed on a DUI charge. He was arrested on Oct. 17, 2012, along Seventh St., by Palmerton police. Given a test, the result was .15BAC.

He was assessed $500, and ordered to get a D&A evaluation, make restitution of $379.32, and license suspended for 60 days.

Christopher R. Frets, 26, of Coaldale, was placed on a DUI charge. He was arrested on Oct. 13, 2012, in the Weissport Canal Park area of Franklin Township.

He was assessed $600, and ordered to get a D&A evaluation, and license suspended for 60 days.

Shannon M O'Brien, 25, of Northampton, was placed on a DUI charge. She was arrested on Oct. 12, 2012, along SR248 by Palmerton police. Given a test, the result was .16BAC.

She was assessed $550, and ordered to get a D&A evaluation, and license suspended for 60 days.

Timothy Ray Smith, 46, of Kunkletown, was placed for six months on a DUI charge. He was arrested on Sept. 18, 2012, along SR248 by Palmerton police. Given a test, the result was .14BAC.

He was assessed $500, and ordered to get a D&A evaluation, and license suspended for 30 days.

Denise Ann Tworkosky, 44, of Shenandoah, was placed on a DUI charge. She was arrested on Sept. 9, 2012, along Penn St., in Franklin Township, by state police at Lehighton. Given a test, the result was .12BAC.

She was assessed $500, and ordered to get a D&A evaluation, and license suspended for 30 days.

Each defendant must also pay court costs, which average close for $1,000, and pay a $50 per month supervision fee while in the program.
