Prize rifle ordered destroyed; other criminal matters handled

A prize Remington model rifle, which had been in a family for a couple of generations, was ordered destroyed by Judge Cyrus Palmer Dolbin after a hearing in Schuylkill County court because it was used in the commission of a crime.

The rifle had been confiscated by state police back in November 2002 when they responded to a domestic incident in the area to 371 Green Tree Drive in West Brunswick Township.Their investigation revealed Jerome Franklin Kimmel fired the rifle in the direction of Diane Kimmel and shots struck the ground near her feet. He was arrested and later pleaded guilty.State police came to court to dispose of the rifle in their possession. A brother of the defendant asked it be returned, but the court ordered it destroyed because there is no proper person to whom the weapon can be given.Revoke paroleSammy Joe Rohrbach, 26, Schuylkill Haven, had his parole revoked by President Judge William E. Baldwin, but received credit for spending 46 days in the county prison and was given a second chance and was re-paroled. However, his 113 days of liberty were disallowed and extended the maximum date of his sentence to May 17, 2014.He had pleaded guilty to retail theft and was placed on parole for two years. His parole was revoked in August 2012, and after he served nine months in prison he was placed back on parole. This was his second revocation.Patricia Ann Hunter, 53, Hanover Township, Luzerne County, had her parole revoked by Judge Jacqueline Russell and she was recommitted to the county prison. Her 377 days of liberty are disallowed, which extends the maximum date of her sentence to March 31, 2015.She had pleaded guilty to retail theft in February 2012 at the Wal-Mart store in Rush Township and was serving a 23-month probation sentence but violated the terms by being arrested in Pittston Township on a retail theft charge.Modify bailBuddy Noel, 34, Pottsville, had his bail modified to $5,000 percentage cash by Baldwin with stipulation he must reside at 91 Pebble Lane, Tamaqua R.D. Noel faces a charge of turning in a false fire alarm in Pottsville last April 28.Joseph Arrigo, 19, Frackville, had his bail modified to $15,000 percentage cash by Baldwin. He faces a charge of default in appearance at the courthouse to be fingerprinted at the Central Booking Office as ordered by court.Todd Scelza, 48, Pottsville, had his bail set at $25,000 straight cash. He was charged by Pottsville police of burglarizing an apartment at 309 W. Norwegian St. while the occupant, Colin Lopez, was at work, and removing electronic equipment.Julio Gonzalez, 36, Reading, had his bail modified to $10,000 percentage cash by Baldwin. He faces charges filed by Pottsville police with being involved in an accident with an attended vehicle, possession of a controlled substance, and failing to have a driver's license.Duane Maurer, 50, Ashland, after a hearing had his bail revoked by Baldwin and he was committed to county prison to await trial on charges filed by Ashland police in connection with a methamphetamine lab found in the 400 block on Catherine Street.Deann Marie McNulty, 29, Saint Clair, had her bail set at $1,000 unsecured and she must reside at 249 N. Front St., Saint Clair, and secure gainful employment. She faces a charge of passing a bad check at the BG Value Store, Pottsville/Minersville Highway.
