Ten area defendants enter guilty pleas

Ten area defendants were among 18 who entered guilty pleas to criminal charges recently in the Schuylkill County Court and where sentenced by Judge Cyrus Palmer Dolbin.

Timothy John Postupack, 33, of 31 Vulcan Road, Barnesville, on a charge of terroristic threats and simple assault on Shannon Ashfield in Saint Clair Borough last Dec. 8 received a jail sentence to run consecutive with the one now serving on an assault charge. His aggregate sentence comes to 12 to 46 months in the county prison with credit for having served 132 days.He also must pay an assessment of $50 to the Criminal Justice Enhancement Account (CJEA) fund and when released on probation perform 20 hours of community service.He was cited by Patrolman Frank J. DeMarco, Saint Clair police. He was sentenced last September by President Judge E. Baldwin after pleading guilty to simple assault also on Shannon Ashfield and was placed on probation for 18 months, however, he violated his probation and was committed to the county prison.Michael D. Starr, 40, of 225 Valley St., Brockton, on a driving under the influence (DUI) of alcohol, was sentenced to serve 48 hours to six months in the county prison with immediate parole on completion of his minimum sentence, fined $500 and costs, pay $100 to Substance Abuse Education (SAE) fund, $50 to CJEA fund, $50 to Catastrophe fund, complete alcohol highway safe driving school, receive outpatient treatment, perform 10 hours community service and driver's license suspended 12 months.Starr was cited by Tamaqua Patrolman Thomas Duarte, last Aug. 27.David Walter Kuczynski, 57, of 564 Green Mountain Road, Zion Grove Village, North Union Township, on a DUI charge was sentenced to serve 72 hours to six months in the county prison with immediate parole upon completion of his minimum sentence, fined $1,000 and costs, pay $300 to SAE fund, $50 to CJEA fund, $50 to Catastrophe fund, complete safety school and outpatient treatment, pay $60 to Schuylkill Medical Center, perform 10 hours community service, and license suspended 12 months.He was cited by Trooper Michael Marinchak last June 25 on SR924 in Mahanoy Township. On a summary charge of failing to yield the right of way was fined $25 plus $50 costs.Leonard E. Rehatchek III, 23,of 219 Stock St., Nesquehoning, on a DUI charge was sentenced to serve 72 hours to six months in the county prison with immediate parole on completion of his minimum sentence, fined $1,000 and costs, pay $300 to SAE fund, $50 each to CJEA and Catastrophe funds, $100 to Coaldale Police Department, complete safety school and outpatient treatment, and perform 10 hours community service.He was cited by Rush Township Patrolman Brian Thompson, on July 10, 2010. Rehatchek previously had been placed in the Accelerated Rehabilative Disposition (ARD) program, a probation time for first offenders but he violated the rules and it was revoked.Robert Jonathan Parthe, 34, of 8 Marcella Road, MaryD, Schuylkill Township, on a charge of possession of an instrument of crime was sentenced to serve two days to 18 months in the county prison and he is to report to the prison in Pottsville on Friday, April 27, at 5:30 p.m. He also must pay a $50 assessment to CJEA, and court costs.Parthe was cited by Trooper Michael D. Marinchak on Oct. 10, 2010.Angela Catherine Plesh, 29, of Hazleton, on a DUI charge was sentenced to serve a 12 months to five years in the county prison effective Friday, May 4, at 6 p.m., with credit for spending 21 days in a rehab center which will go towards her jail time and she is eligible for work release. On a charge of driving while under suspension-DUI related, must spend a flat 90 days additional to the 12 months in the county prison.Pleash must pay a fine of $2,500 plus costs, $50 to the CJEA fund, $200 to Catastrophe fund, and perform 10 hours of community service. Her driver's license is suspended 18 months and for 12 months she must have an ignition interlock installed in her vehicle which monitors if the driver has ingested any alcohol.She was cited by Klin e Township Officer Patrick Loftus, on Feb. 12, 2011, on Market Street in Kelayres.Susan Rochford, 29, of 125 Coal St., Cumbola, Blythe Township, on a charge of forging a credit card belonging to Nicole Corby, 24 Main St., Cumbola, was placed on probation 18 months, pay $50 to CJEA fund, and make restitution of $215.57.Joshua Michael Dewire, 22, of 66 Holland St., Tamaqua R.D., on a charge of simple assault on Jermaine Davis in the Tiki Bar in Tamaqua with a pool stick on Feb. 17, 2011, was sentenced to serve 23 months on probation, pay $50 to CJEA fund, and make restitution of $1,209,10 to the victim.Brian Richard Viechec, 32, of 36 Main St., Jeddo, Freeland R.1, on a charge of criminal conspiracy to commit theft from the Mazeika Coal Company in Rush Township was sentenced to serve one to two years in a state correctional facility with credit for serving 114 days in the county prison, pay $50 to the CJEA fund, and make restitution of $12,635 to the coal company.He is to report to County Sheriff Joseph G. Groody on Monday, April 23, at 9:30 a.m. to be transported to a state prison. Viecheck was cited by LRlush Cpl. Duane Fredericks, last July 12.Jason Allan Weaver, 30, of 219 Market St., Tamaqua, on a charge of criminal conspiracy to commit credit card fraud and theft of credit card belonging to Amy Wagner, was sentenced to serve six to 23 months in the county prison, pay a $50 assessment to CJEA fund, and make restitution of $11.98 to M&T Bank.He is to report to the prison on Monday, April 23, at 9 a.m. to begin his sentence. Weaver was cited by Tamaqua Cpl. Henry Wood, last Nov. 29.Brittany Mae Shadle, 20, Hegins, on a charge of possession of a small amount of marijuana and drug paraphernalia was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA fund, perform 10 hours community service, and make restitution of $113 to Bethlehem Regional Lab.Shadle was cited by Hegins Township Sgt. Beau Yarmush, on March 19, 2010. She previously was in the ARD probation program which was revoked.Khyle William Willis, 19, Schuylkill Haven, on a charge of DUI was sentenced to serve 48 hours to six months in the county prison and when he serves the minimum will be released on parole, fined $500, pay $100 to SAE fund, $50 to CJEA fund and Catastrophe fund, complete safety school, perform 10 hours community service, and license suspended 12 months.Willis was cited by Trooper Jeffrey Hummel when stopped on Dec. 18, 2010, on Pleasant Valley Road. He previously was in the ARD program which was revoked before he completed 12 months probation.Daniel Paul Reber, 34, Schuylkill Haven, on a charge of simple assault on his wife, Melissa, on Jan. 21, 2011, was given credit of spending 11 days in the county prison and was placed on parole for 23 months, pay $50 to CJEA fund, and perform 40 hours of community service. On a charge of inhaling a toxic substance filed by Schuylkill Haven Patrolman Gregory Meisner, he received a concurrent 12 months probation sentence.Robert C. Miller, 35, Tower City, on a charge of passing a bad check was placed on probation 12 months, pay $50 to CJEA fund, perform 10 hours community service, and make restitution of $655.99 to Cellutions Company.He was cited by Trooper Eric T. Poriglia on Dec. 12, 2010.Mark T. Macaluso, 61, Mahanoy City, on a DUI charge was placed in the Intermediate Punishment Program (IPP) for six months with the first 25 days under house arrest with electronic monitoring at $12 per day cost, followed by four months and 35 days on probation, fined $300, pay $100 to SAE fund, $100 to Catastrophe fund, $50 to CJEA fund, attend safety school, receive outpatient treatment, make restitution of $60 to Schuylkill Medical Center, perform 20 hours community service, license suspended 12 months, and ignition interlock installed on car for 12 months.Macaluso was cited by Mahanoy City Officer Robert Romanick, last June 20. On a summary charge of stop sign violation was fined $25 plus $50 costs.Jericho Scott Linkchorst, 19, Frackville, on a charge of vandalism of school property was sentenced to serve six to 23 months in the county prison with the sentence to begin Friday, May 18, at 9 a.m., pay $50 to CJEA fund, and make restitution of $880 to Frackville Football Association. He was cited by Patrolman George Parnell, last July 4.James Allen Zemaitis, 34, Tower City, on a charge of possession with intent to deliver a controlled substance in Tower City was placed on probation two years, pay $100 to SAE fund, $50 to CJEA fund, and make restitution of $113 to Bethlehem Regional Lab. Zemaitis was cited by Trooper William Volchko on March 16, 2011, at his home.Dawn P. Frakes, 25, Tower City, on a charge of possession of a controlled substance and drug paraphernalia at her residence was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA fund, and make restitution of $113 to Bethlehem Regional Lab.Each defendant must also pay additional court costs and a $50 per month supervision fee while on probation or parole.
