Two first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Tuesday on driving under the influence (DUI) charges.

If both successfully completes the conditions of the program their record will be wiped clean. If they fail to complete the program or are revoked from it the Commonwealth reserves the right to prosecute them on all pending charges. A person does not admit guilt in entering the program.

Senior Judge Richard W. Webb placed the two for a year. They were:

Wayne S. Henrick, 60, of Lansdale, who was arrested on June 12, 2010, and William J. McMichael II, 40, of Lehighton, who was arrested on July 20, 2010.

Both were arrested along Mauch Chunk St., in Mahoning Township. Henrich was given a test, resulting in a .18BAC, and McMichael's test revealed a .17BAC.

Each was ordered to pay $450 for the cost of the program, get a drug and alcohol evaluation and follow any recommendation for treatment, pay court costs, pay a $50 per month supervision fee while in the program and each had their license suspended for 60 days.
