The suit states the parties conducted a business at 21 Chestnut St., Tresckow. The plaintiff engaged in various excavation and site contracting business and has done so since its incorporation in March 2007.
The suit claims after the defendant discontinued his work with the plaintiff he began to use the trade name "Choice One Construction" and "Choice One Site Contractors Inc." representing himself out as representing the business interests of the plaintiff and moreover confusing similar names.
The suit further alleges the actions by the defendant resulted in him completing jobs over the past several years which jobs were intended for the plaintiff.
The plaintiff is claiming misuse of name, diversion of business opportunity and other allegations. Sought are damages in excess of $50,000.
