A jury was selected Thursday to begin hearing testimony on Monday in Schuylkill County Court in the civil suit brought by Byrd Yeany, trading as Byrd Yeaney Seeding and Mulching Company, of Mayport, who is sueing Napcon Inc., of Wilkes-Barre and the Commonwealth Insurance Company, of Bala Cynwyd, for alleged breach of contract for work performed on the reclamation project on Pigash Mountain located partly in Tamaqua and partly Coaldale boroughs. The area had been strip mined.

The company alleges in its complaint $50,080 is still owed under terms of the contract while Napcon takes issue with the work perform and alleged expenditures to re-seed and re-grade the area and is seeking costs for the work. Judge D. Michael Stine will be the trial judge.
